1. Introduction

to QPulse ("the Platform"), an AI-powered social
media automation and scheduling service operated by Local
Webcafe ("we," "us,"
or "our"). These Terms and Conditions ("Terms")
govern your access and use of QPulse, including all features, services, and
integrations.
By
registering, accessing, or using QPulse, you ("User,"
"you," or "your") agree to comply with these Terms. If you
do not agree, you must discontinue use immediately.
2. User Eligibility & Account Responsibilities
a) Eligibility
- You must be at least 18 years old or
the legal age of majority in your jurisdiction.
- Businesses and agencies must ensure
authorized personnel comply with these Terms.
b) Account Security
- You must provide accurate and
current registration details.
- You are solely responsible for
maintaining account confidentiality and all activities under your account.
- Notify us immediately of unauthorized
access or security breaches.
c) Acceptable Use
You
agree not to use QPulse to:
❌ Violate any laws, regulations, or third-party rights (including
intellectual property).
❌ Post harmful, abusive, or illegal content (e.g., hate
speech, malware, misinformation).
❌ Spam, harass, or deceive others via automated posts.
❌ Reverse-engineer, scrape, or exploit QPulse’s infrastructure.
3. Platform Services & Limitations
a) Service Description
QPulse
enables:
✔ Scheduling & automation of posts on Facebook,
Instagram, LinkedIn, Twitter (X), YouTube, and more.
✔ AI-generated content suggestions and analytics.
✔ Team collaboration tools (for business/agency plans).
b) Service Availability
- We strive for 99.9% uptime but do not guarantee
uninterrupted service due to:
- Maintenance, third-party API outages, or
force majeure events (e.g., natural disasters).
- Scheduled downtimes will be communicated
via email or in-app notifications.
4. Payments, Subscriptions & Refunds
a) Pricing & Billing
- Fees are outlined on our Pricing
Page and billed monthly/annually via secure
payment gateways (Stripe, PayPal).
- You must provide valid payment
details and update them promptly.
b) Renewals & Cancellations
- Subscriptions auto-renew unless
cancelled 7 days before renewal.
- No refunds for partial months, but you may
cancel anytime.
c) Refund Policy
Refunds
are evaluated case-by-case for:
- Technical failures preventing core functionality.
- Duplicate charges or billing errors.
5. Content Ownership & Copyright
a) Your Content
- You retain ownership of
all content posted via QPulse.
- By using QPulse, you grant us a limited,
non-exclusive license to process, store, and transmit your
content only for automation purposes.
b) Prohibited Content
You must
not schedule/post:
⚠️ Copyrighted material without permission.
⚠️ Adult, violent, or deceptive content.
⚠️ Misinformation or fake engagement (e.g., bots).
c) Third-Party Liability
QPulse is
not responsible for:
- Account suspensions by Facebook, Instagram, etc. due to policy
violations.
- Legal consequences from your posted content.
6. Termination & Suspension
a) By QPulse
We
may suspend or terminate accounts for:
- Violations of these Terms.
- Payment failures (30+ days overdue).
- Abusive behaviour (e.g., spamming, fraud).
b) By You
- You may delete your account anytime
via Settings.
- Data removal from third-party platforms
remains your responsibility.
7. Limitation of Liability
QPulse is
provided "as is" without warranties. To the fullest
extent permitted by law:
- We exclude liability for:
- Downtime, data loss, or service
interruptions.
- Damages from misuse or third-party
actions.
- Our total liability is limited to
fees paid in the last 6 months.
8. Changes to Terms
- We may update these Terms with 30
days’ notice (email or in-app alert).
- Continued use after changes constitutes
acceptance.
9. Governing Law & Disputes
- These Terms are governed by UK
law.
- Disputes will be resolved via negotiation,
then binding arbitration if needed.
